Terms and Conditions

General

The contract is between you, the person who is renting Tigh Lachie and the owners of Tigh Lachie.

Your responsibilities

You must keep the holiday accommodation at Tigh Lachie and all furniture and fittings in the same state of repair and condition as at the commencement of the holiday. You must leave the premises in the same state of cleanliness and general order in which you found it on your arrival. You will be responsible for all breakages, damage or loss to the property during your rental period and will be responsible for paying appropriate compensation in the event of any breakages, damage or loss. You should report any items accidentally broken or damaged prior to your departure from the cottage (The odd broken glass, plate or bowl is not an issue but burns by people who should not be smoking in the cottages or pets that chew furniture would require compensation). Please also report any problems or failures in a timely manner so that it can be dealt with as soon as possible.

Formation of the contract

Before making a booking please ensure there is availability either by contacting the owners or by checking the online availability charts. Thereafter a non-refundable deposit of £100 is required to secure your booking. Acknowledgement of receipt of the deposit will be sent by email. No booking shall be for longer than 3 weeks unless by prior arrangement. Sub-letting is strictly prohibited. The number of guests and pets must be stated at the time of booking. Overnight guests are permitted by prior arrangement only.

Payment

The balance is due 4 weeks prior to the commencement of the holiday unless previously arranged with the owner. Failure to pay the balance on time will constitute cancellation and cancellation charges may become payable. If the booking is less than 4 weeks prior to the commencement of the holiday the full balance of the holiday is payable at the time of booking unless previously arranged. Out with these arrangements payment may be made in full at the time of booking.

Cancellation by Tigh Lachie

In the unlikely event Tigh Lachie are forced to cancel the reservation (for reasons out with our control such as fire, flood, etc) we will inform you as soon as possible. We will also attempt to find alternative accommodation of a similar standard and location. If we are unable to provide acceptable alternative accommodation Tigh Lachie will refund all monies paid and shall be under no liability. In the event we have to cancel due to being closed because of Government restrictions that fall during your booked holiday with us we will refund you in full any monies you have paid to us.

Cancellation by you, the person who is renting the cottage.

If the cancellation is more than 4 weeks prior to the commencement of the holiday only the deposit will be lost. If the cancellation is within 4 weeks of the commencement of the holiday then the full cost of the booking is due. Due to the potential cost of cancellation we strongly advise that you take out holiday insurance. As well as holiday cancellation and curtailment insurance, guests are recommended to take out holiday insurance cover to cover loss or damage to personal effects. Vehicles, accessories and vehicle contents are left at the owner’s own risk. The owners will not be responsible for any loss, damage or personal injury not caused through the fault of the proprietor.

You can, however, upgrade your purchase to a refundable booking and be protected should the worst happen and you are unable to travel due unforeseen circumstances such as injury or illness affecting you or your immediate family. You're covered for: Injury or illness (includes COVID-19) happening to you, or a member of your immediate family. Mechanical breakdown, accident, fire or theft en route of a private vehicle taking to the booking event. Adverse weather conditions including snow, frost, fog or storm where the Police or Government have issued travel warnings. Pets

Pets are permitted in the cottages by prior arrangement with the owners. Well behaved, house trained dogs are welcome at Tigh Lachie. However, the repair or replacement costs of damage caused by a pet will be at the pet owners expense. The costs will also include if the damage is excessive the cost of refunds or the cost of alternative accommodation for following guests. We will not be liable for any incident involving your dogs staying at Tigh Lachie where the dogs owners have not complied with the law.

Access

Access to the cottage on the day of arrival is from 4:00pm although if you arrive a little earlier, and your cottage is ready, you will have earlier access. On the day of departure, you will vacate the property by 10:00am to allow our housekeeper to prepare the cottage for our next guests. The owners or their representative shall be allowed free access to the property when and as required. The owners or their representative reserve the right to refuse admission to their property and to require any person to leave when they consider there is a breach of contract or deem that there is damage to the property or cause of nuisance or conduct in an offensive manner.

Tigh Lachie responsibilities

Tigh Lachie, in the event of failure of any equipment or facilities such as boilers, oil supply, water supply, electricity supply we will endeavour to repair, have repaired, restore or have replaced as required the necessary equipment as soon as we possibly can. However we will not be held responsible for failures that are out with our control.

Smoking

For health, safety and fire reasons Tigh Lachie operates a strict no smoking policy in and around the cottage

Law

All contractual obligations arising from the booking of Tigh Lachie and these Terms and Conditions shall be deemed to come into existence in Elgol, Isle of Skye, Scotland, UK and be subject to Scots Law and the exclusive jurisdiction of the Scottish Courts.
